Energizer Wins Preliminary Junction Over Gillette

December 9, 2005

A U.S. district court judge in Connecticut has granted the Schick-Wilkerson Sword subsidiary of Energizer Holdings Inc. a preliminary injunction against alleged false advertising claims by The Gillette Co. for its M3Power razor.
According to Energizer Holdings, the judge found Gillette’s claim that its M3Power raises hair up and away from the skin both “unsubstantiated and inaccurate.” As a result of the preliminary injunction, Gillette must stop making the claim in advertising within 30 days and must change packaging for the product and remove in-store displays that feature the claim, Energizer said.
