Procter & Gamble Settles Lawsuit
2006-09-01 | 08:29
Procter & Gamble Co. has reached a settlement with Cumberland Swan Holdings Inc. for alleged trade dress infringement and false advertising of P&G’s Crest Pro-Health oral rinse products. Smyrna, Tenn.-based Cumberland Swan denied the allegations but has agreed to stop manufacturing, distributing and selling the products in question, according to Procter & Gamble. “This case was about consumers being misled into believing that they were buying products comparable to Crest Pro-Health,” said Jim Johnson, chief legal officer for Procter & Gamble. “We're satisfied that Cumberland Swan must now compete with its own designs and substantiate its performance claims with meaningful testing, as we do.”
