Deadline Nears for NJ Recycled Content Law

Manufacturers must register with the NJ Department of Environmental Protection by July 18, 2022.

On January 18, 2022, Governor Phil Murphy signed P.L. 2021, c. 391 [N.J.S.A. 13:1E-99.135-157], “an Act concerning the use of postconsumer recycled content in certain containers and packaging products.” The Law is intended to stimulate recycling markets by requiring manufacturers to meet minimum recycled content standards for covered products sold or offered for sale in New Jersey.

Manufacturers of covered products are required to register with the New Jersey Department of Environmental Protection (NJDEP) by July 18, 2022 and annually thereafter. Manufacturers are also required to pay a $1,000 registration fee to be billed after the registration is received by the NJDEP. Exceptions to the registration fee or annual registration requirement are detailed in the Registration Instructions Document.

To register, download the Manufacturer Registration Form and Registration Instructions. Follow the instructions provided in the Registration Instructions document for submission of the Manufacturer Registration Form to the NJDEP.

TA spreadsheet for manufacturers to list brands of covered products was previously available but has since been removed by the Department and the deadline to submit brands has been extended to July 18, 2023. An updated spreadsheet for manufacturers to list covered brands under the Law will be provided on this website in the future. Please check back for updates.
