Florida Governor Ron DeSantis has signed SB 172, the move preempts all city and county efforts to regulate over-the-counter “proprietary drugs” and cosmetics to the state effective July 1, 2020. Last year the Key West City Council passed a local law banning the sale and distribution of any SPF sunscreen protection personal care product that contains oxybenzone or octinoxate or both as of January 1, 2021. In addition, several other local governments considered similar proposals. SB 172 preempts the existing Key West ban and any other future attempts at the local level in Florida.
Industry experts point out that following Hawaii in 2018, Key West introduced an ordinance to ban the sale of sunscreens containing oxybenzone or octinoxate. In Q1 2019, it became a regulation and was to be effective as of January 1, 2021. SB 172 preempts the existing Key West ban and any other future attempts at the local level in Florida.
