The Federal Trade Commission (FTC) recently issued a final rule on “Made in USA” and other unqualified U.S.-origin claims on product labels, which became effective on Aug. 13.
The rule codifies FTC’s previous decisions and prohibits manufacturers and marketers from making “Made in USA” claims on labels unless the following three mandates are adhered to:
(1) Final assembly or processing of the product occurs in the U.S.;
(2) All significant processing that goes into the product occurs in the U.S.;
(3) All or virtually all ingredients or components of the product are made and sourced in the U.S.
