The Independent Cosmetic Manufacturers and Distributors (ICMAD) has issued its response to the Senate HELP Committee discussion draft on the Modernization of Cosmetics Regulation Act of 2018:
“After in-depth review of the United States Senate Committee on Health, Education, Labor and Pensions (HELP) discussion draft on the Modernization of Cosmetics Regulation Act of 2018, the Independent Cosmetic Manufacturers and Distributors (ICMAD) have provided the attached letter to the HELP Committee staff accompanied by ICMAD’s specific comments on the draft.
“ICMAD and its more than 900 member-companies are ardent supporters of modernizing federal cosmetics regulations provided the updated law continues to foster innovation, ensure safety and keep the US as a worldwide leader in the cosmetics industry.
“The cosmetics industry is backed by years of science-based research and testing and represents one of the safest categories regulated by the Food and Drug Administration (FDA). After reviewing the HELP Committee’s discussion draft, we are disappointed in the significant departure from the current law and new impositions that place unnecessary and burdensome constraints on cosmetics companies. As we have discussed with Senate and House staff, the approach ICMAD endorses stipulates:
1) the current voluntary registration program would be mandatory;
2) the addition of a Serious Adverse Event Reporting requirement; and,
3) National Uniformity which can support a strong Federal Cosmetics program.
“ICMAD, as a representative of the entrepreneurial segment of the cosmetics industry with membership comprised of small, medium and large companies, as well as start-ups, maintains that national uniformity must be at the center of any modern regulatory effort.
“We look forward to continuing a productive dialogue with Senate & House staff on the modernization of cosmetic regulations to provide long-term support for American companies’ leading role in promoting quality, safety and innovation in the global cosmetics industry.”
