Cot’n Wash Files Suit Against Henkel and Sun

Maker of Dropps says detergent pacs violate its IP.

Cot’n Wash, Inc. has filed a lawsuit today against Henkel AG’s Dial Corp. and Sun Products Inc. The lawsuit, filed in the US District Court of Delaware, alleges that Henkel and Sun Products are violating Cot’n Wash Inc.’s intellectual property by manufacturing and selling liquid unit dose laundry detergent.


Cot’n Wash, Inc. is suing in order to protect its investment in its technology and its Dropps liquid unit dose laundry detergent business.

The lawsuit asserts that Henkel is violating Cot’n Wash, Inc.’s intellectual property by manufacturing and selling laundry products including Purex UltraPacks Mountain Breeze and Purex UltraPacks Free and Clear.


The lawsuit also claims that Sun Products is violating Cot’n Wash, Inc.’s intellectual property by manufacturing water-soluble liquid laundry packets under the All Mighty Pacs, All Mighty Pacs Free and Clear, and Sunlight Triple Clean Pacs.

Additionally, the lawsuit alleges that Sun is also supplying liquid water-soluble laundry packets to retailers, who sell the packets under their own brand names.

“Laws prohibiting patent infringement are there to protect innovative companieslike Cot’n Wash, Inc. as well as the consumers who use our products,” said Jonathan Propper, Cot’n Wash, Inc. president, in a press statement. “We will take all necessary actions to protect Cot’n Wash, Inc. and its shareholders from unlawful competitive practices, including infringement of our intellectual property rights.”

Dropps laundry detergent pac product, introduced in 2006, is based on the original Cot’n Wash liquid formula sold in bottles. Dropps laundry detergent is packaged in a water-soluble film pac using patented, exclusive licensed technology.
