Michael Todd Settles Suit with Pacific Bioscience

Firm to continue selling Soniclear Sonic Skin Cleansing Brushes.

Michael Todd LP maker of the Soniclear antimicrobial sonic skin cleansing system, has entered into a definitive final agreement to settle a complaint brought by Pacific Bioscience Laboratories before the International Trade Commission (ITC) and US District Court for the Western District of Washington. Through the settlement, Michael Todd will continue to sell sonic skin cleansing devices, brushes and chargers.
 
The parties will file joint motions to terminate the ITC investigation as to Michael Todd and dismiss with prejudice all claims against Michael Todd in the District Court Action. The specific terms of the settlement are confidential, but neither of the parties makes any admissions or concessions regarding the merits of the other party's claims, according to a statement released by Michael Todd.
 
On April 30, 2015, Pacific Bioscience Laboratories, Inc. filed a complaint requesting that the ITC commence an investigation pursuant to Section 337. The complaint alleged that several companies, including Michael Todd True Organics, were unlawfully importing into the US, selling for importation, and/or selling within the U.S. after importation certain electric skin care devices, brushes and chargers, and kits containing that infringe one or more claims of three US Patents in addition to infringing PBL's trade dress. 

According to Michael Todd, settling the cases at this time is in the best interests of the parties.
