NAD Refers Mask, LLC to FTC

The National Advertising Division (NAD) of BBB National Programs has referred advertising claims made by Mask, LLC to the Federal Trade Commission (FTC) for review after the company declined to comply with NAD’s recommendations to discontinue the product name “Spotless Blemishes & Oily Skin Soothing CBD Sheet Mask,” as well as the claim “Helichrysum Essential Oil may work to help heal blemishes, encouraging signs of skin renewal and cell turnover to lessen the look of redness and scarring.”
 
Through its routine monitoring program, NAD requested substantiation for the following express claims:
 
Spotless Acne & Psoriasis Sheet
• “Spotless Acne & Psoriasis Sheet”
• “This full-spectrum CBD-infused sheet masks calms signs of inflammation, returning skin to a calmer, clearer state.”
• “This solution works to help heal acne and psoriasis, encouraging signs of skin renewal and cell turnover to lessen the look of redness and scarring.”
 
Spotless Blemishes & Oily Skin Soothing CBD Sheet Mask
• “Spotless Blemishes & Oily Skin Soothing CBD Sheet Mask”
• “Helichrysum Essential Oil may work to help heal blemishes, encouraging signs of skin renewal and cell turnover to lessen the look of redness and scarring.”
 
NAD noted that the product name, Spotless Blemishes & Oily Skin Soothing CBD Sheet Mask, expressly claims that the mask confers two benefits: spotless blemishes; and soothes oily skin. NAD recommended that the product name be discontinued because the advertiser did not conduct or provide any testing on the product itself to support these product performance claims.
 
Further, NAD said it determined that the advertiser failed to provide a reliable ingredient study demonstrating that the amount of helichrysum essential oil found in the product (which the advertiser never specified) has a positive effect on blemishes. Therefore, NAD recommended that the claim “Helichrysum Essential Oil may work to help heal blemishes, encouraging signs of skin renewal and cell turnover to lessen the look of redness and scarring” be discontinued.
Finally, NAD noted that it appears that the Spotless Acne & Psoriasis Sheet product originally marketed is now being sold under a different name with modified claims. NAD did not review the product name and originally challenged claims on their merits. 
 
In its advertiser’s statement, Mask LLC stated that it will not comply with NAD’s recommendations, noting that  “there is no basis to conclude that the product claims to remove blemishes simply because the word ‘spotless’ is in the product name.” Further, the advertiser stated that “at no time does MASK Skincare claim that Helichrysum Essential Oil absolutely and without qualification has a beneficial or positive effect on the skin.” 
Considering the advertiser’s decision, NAD has referred the matter to the attention of the appropriate government agency for possible enforcement action.
