Pacific Specialty Oils Files Suit Against Avon

Says company illegally used

Pacific Specialty Oils, Inc. (PSOI), manufacturer the HTY Gold skin care line, has filed suit against Avon Products, Inc. in the U.S. District Court of NY, claiming Avon is illegally using HTY Gold registered trademarks, including the trademark “HTY Gold” and the trademark “Night Gold.”


According to Pacific Specialty Oils, Avon.com was promoting a web page with the heading “H T Y Gold” which, in addition to illegally using the “HTY Gold” trademark, diverted consumers searching for the real HTY Gold products to the Avon website, where Avon advertised competing products.

The suit also claims that Avon’s falsely labeled “H T Y Gold” page was regularly in the top results of internet searches for “HTY Gold”, “Body Gold”, “Night Gold”, “Day Gold,” and “Eye Gold”. Among the products on Avon’s “H T Y Gold” page was Avon’s Ultimate Night Gold Emulsion, which illegally uses HTY Gold’s “Night Gold” trademark and directly competes with the HTY Gold Night Gold cream, at a cheaper price.

PSOI alleges that Avon’s deceptive practices both misled consumers and violated Federal trademark and competition law.

Avon has removed the “H T Y Gold” webpage, but Avon is still liable for the damage and confusion it caused, according to PSOI.
