Skin care brand Sachi Skin has filed a lawsuit against Current State, whose parent company is Seemark Brands, alleging trademark infringement.
Per court documents, Sachi Skin – founded by Farah Bashir with four products which holds trademarks for States of Skin, New States of Skin, State of Change – alleges Seemark Brands and its cofounders, Emily Parr and Majeed Hemmat, of trademark infringement in addition to false designation of origin and federal unfair competition, and dilution by blurring and/or tarnishment, among others. Sachi Skin Care, who sent a cease-and-desist letter to Current State earlier this year, reportedly stated in the suit that their competitor was selling skin care products “confusingly similar” to Sachi.
Current State, which launched in Target earlier this year, is the sister brand to HoliFrog.
Sachi Skin has applied to trademark Skin States. However, in a petition dated January 26, Seemark Brands filed for cancellation of plaintiff’s “States of Skin” trademark registration, citing the phrase as an oft-used descriptor that they argue does not function as a trademark.
Parr and Hemmat reportedly requested Sachi Skin’s consent to coexist as part of its application to register Current State of Skin. The request was not granted, and the application was refused, according to the lawsuit.
